Terms and Conditions
Section 1: Customer service policy
We want our watches to go to nice people - which fortunately is most of our supporters. But for the rest: no manners, no service.
We reserve the right to ignore abusive messages and antisocial behaviour, cancel/refund associated orders and blacklist any such individuals.
Section 2: Anti-flipping policy
We're watch enthusiasts who want to make and share watches with other enthusiasts. Unfortunately, flipping results in genuine collectors missing out or paying significant premiums on a watch they would like to own and we think this is unfair. Hence - an anti-flipping policy.
We reserve the right to refund and blacklist any individuals identified as flippers. Flipping in this context is described as:
- Purchasing multiple watches from a single launch, especially if to the same address or using different names. We would like as many people as possible to have the opportunity to purchase; please don’t be selfish.
- Selling a watch before delivery. If a watch has yet to be delivered, we offer customers the opportunity to cancel for a full refund in most cases. So there should be no need to sell a watch even before delivery.
- Selling a watch for a profit within the two week return period. Whilst we understand the first time you see a watch in the metal may be when you receive it, there are return options if you find it's not for you
While these are the two primary criteria for 'flipping', we will evaluate on a case by case basis as well.
Section 3: Orders and pre orders
- All orders are subject to acceptance by MING and availability of watches.
- Payment is accepted via Payment Express which accepts Visa and MasterCard. We also accept payments via bank wire for certain products.
- We strive to have all watches listed as available in stock and ready to ship, but sometimes watches may be on pre-order or temporarily out of stock. In such cases, MING will inform you without delay and offer you the option of (i) advance payment to secure shipment from the next available batch or (ii) notification once the watch is back in stock.
- Orders are considered accepted once watches are shipped, cancellations will not be possible after this. However, the owner has the right to return the watch within two weeks. For details refer to ‘Returns’ below.
- MING reserves the right to not accept an order for reasons including, but not limited to, non-clearance of payment, shipping/import restrictions of the destination country and ordered watches being out of stock
- Pre order deposits may be cancelled for a 50% refund at any time up till shipment. In the unlikely event we are unable to deliver a product at all, a full refund will be made. Watches will be delivered in the order deposits were received.
- We make every effort to deliver watches to the schedule indicated, but delays sometimes occur due to circumstances outside our control. This does not constitute complete failure to deliver and a cancellation due to a delay is considered customer initiated and eligible for a 50% refund only. In the event the delay is longer than six months a full refund will be given.
- We reserve the right to update, amend and improve products on an ongoing basis.
- In cases where orders cannot be accepted, any payments made will be promptly refunded in full.
- MING stores records of all sales transactions for a minimum of the watch’s warranty period.
- The order contract is concluded in Kuala Lumpur, Malaysia, and the language of the contract is English.
- All products will be shipped worldwide via DHL Express, with insurance and tracking.
- DHL will require a signature or authorisation to drop off from the buyer or their appointed representative at delivery, at which point responsibility for purchased goods passes to the buyer.
- The buyer or their appointed representative’s signature on acceptance of the shipment is considered evidence of the date of delivery and fulfilment by MING.
- Taxes, customs levies and import duties are not included in the product price (except for deliveries with Malaysia).
- Any customs levies, import duties and local taxes are the sole responsibility of the buyer.
- Shipping restrictions:
- At this time, we are unable to ship to Israel due to prevailing import/export regulations.
- Shipments to Russia require a commercial address i.e. need to be shipped to an office, company etc and cannot be shipped to a personal address.
- Each watch comes with a limited warranty against mechanical defects. The duration can be found on the documentation that accompanies each watch.
- Mechanical watches are precision mechanical products and any excessive shocks or vibrations, exposure to strong electromagnets and similar activities can cause damage to or affect their functionality. The mechanical warranty does not cover issues occurring due to mishandling as it falls outside the normal scope of use. If you are uncertain if a particular activity is safe for the watch, please e-mail us and we'll be happy to clarify.
- Watches are not user serviceable. We cannot guarantee water resistance or mechanical function of the watch if the watch case has been opened or serviced by the customer or a third party, and doing so will void all warranties.
- Wear and tear (e.g. water damage to straps, scuff marks to the case or buckle, etc.) is not covered by the warranty. This extends to any external coatings or treatments, such as DLC coating, heat bluing or AR coating, to the watch case, crown, crystal and buckle.
- For a warranty claim, we reserve the right to replace the watch or relevant components with ones of equivalent, or greater value in the event parts are no longer available.
- Should the owner request a watch service or should repairs be necessary outside the warranty period, the work will be charged depending on scope. MING will furnish a cost estimate for the repair and should the owner not authorise MING to undertake the repair work, the watch will be shipped back at the owner’s cost.
- In case of a warranty claim, or service request, please email us at firstname.lastname@example.org for a Service Authorization (SA) form, which includes shipping details.
- For warranty work, shipping to MING is at owner’s cost and safety of the package while in transit back to MING is the responsibility of the owner. However, at the owner's request, MING can arrange for shipping and insurance and the charges will be invoiced separately.
- For out-of-warranty service, both legs of shipping are at the owner’s cost.
- You may return the watch to either MING in Kuala Lumpur, or to one of our service partners - please contact us for details.
- While we will try our best to make repairs and return a watch to proper working condition, it is sometimes not economically viable or possible to repair a watch if the damage is extensive enough.
- Watches may be returned in unused and unworn condition complete with the original packaging, with the watch still sealed and vacuum packed, and all accessories supplied (including all straps and buckles, MING tags, and protective coverings) included within two (2) weeks of receipt of the original shipment for a refund minus return shipping fees.
- Straps are considered consumables and are not eligible for returns. All strap sales are considered final once shipped.
- Outside the two (2) week period, all sales are final.
- Please email us at email@example.com for a Return Merchandise Authorization (RMA) form. All returns must be accompanied by a RMA form, unless otherwise agreed upon in writing.
- MING will provide the buyer with a prepaid return label and arrange for insurance during transit. A return shipping fee of CHF75 for a 17 series and CHF 125 for a 19 series will be deducted from the refund.
- Buyers may choose to arrange for return shipping on their own. Responsibility of the watch during transit is the buyer's responsibility under these circumstances.
- If we find the watch to be in a used condition or incomplete, we will be unable to accept the return and will contact you to have the watch shipped back to you.
- MING will refund you within two (2) weeks upon receipt of the returned good(s) using the same means of payment used for purchase. Upon customer’s request, a refund can be made in the form of store credit, to be used for future purchases at MING.
MING reserves the right to update these policies as deemed necessary and at our discretion. The latest version will supersede all preceding versions (except for duration of warranty which is fixed at time of purchase).
